The Community Housing Coalition of WA (CHCWA) is bound by the National Privacy Principles (“the NPP”) as set out in the Privacy Act 1988 (as amended by the Privacy Amendment (Private Sector) Act 2000).

In order to comply with our obligations under the National Privacy Principles (NPP) we have a Privacy Policy, which describes how we manage privacy within our organization. Privacy agreement

Your access to the information on this website is subject to the following legally binding terms and conditions. Please read carefully before proceeding. This Privacy Agreement incorporates by reference the requirements and procedures of the Acts. In order to understand fully the rights and responsibilities that flow from the Acts, you are advised to refer to a complete and official version of those Acts.

Application

This Privacy Agreement applies to all services on the website unless a page on the website specifically indicates otherwise.

Exceptions

Any exceptions to the Privacy Agreement permitted by law shall be identified at the time any personal information to which such exception applies is being collected and used.

The CHCWA website does record some personal information which includes your given name and surname, your e-mail address and your telephone number to fulfill legitimate requests and objectives of the website.

Except where permitted and/or required by law, your consent will be obtained before personal information is used or disclosed on the website.

Membership

Access to certain information and/or services on the website requires completion of a membership application form and creation of an acceptable login name.

Where no consent obtained

Refusal to consent to disclose personal information when it has been requested may limit the ability to access and enjoy certain website information, pages, products and services.

Information shall be collected using only legal and lawful means.

Use of personal information shall be limited to that which is necessary for the purposes identified by the website or as permitted or required by law. Personal information shall be protected by safeguards that are required by law and that are in accordance with generally accepted industry practice.

Responsibilities regarding personal information

You are not permitted to share your user name and password with anyone except as agreed to under this Privacy Agreement. Website administrators will not require you to divulge or disclose your user name or password in written or electronic communications.

Limited liability from links to other sites

Where the website provides links to websites outside the CHCWA website, CHCWA is not responsible for privacy practices of those other sites. You are hereby advised to read the privacy statements of each and every website that collects personal information. The Privacy Agreement applies solely to information included on the CHCWA website.

Annual review of and notice of change to Privacy Agreement

CHCWA shall review the Privacy Agreement annually to ensure that the use, disclosure and disposal of personal information is carried out in a manner required by law. CHCWA reserves the right to change the Privacy Agreement at any time. You will be notified of any changes to the Privacy Agreement and you will be required to review and accept the new Privacy Agreement to be granted continued access to and use of the website.

CHCWA's compliance with the Privacy Agreement

You may challenge CHCWA's compliance with the Privacy Agreement in accordance with the access procedure and appeal process set forth in the Act. The Privacy Agreement shall be governed by the laws of Australia.

The parties have required that the Privacy Agreement and all documents relating hereto be drawn up in English.

Any provision of the Privacy Agreement which is held to be invalid, illegal or unenforceable by a court of competent jurisdiction shall, as to that jurisdiction, be ineffective to the extent of such prohibition or unenforceability and shall be severed from the balance of the Privacy Agreement, all without affecting the remaining provisions of the Agreement or affecting the validity, legality or enforceability of such provision in any other jurisdiction.
